Terms and Conditions of Service for Best Plan Courier

1. Introduction
Welcome to Best Plan Courier (“BPC,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our courier and delivery services (“Services”). By booking a delivery, using our website, or engaging our Services, you (“Customer,” “you,” “your”) agree to be bound by these Terms.
2. Services Provided
BPC provides courier and logistics services, including but not limited to: same-day delivery, scheduled routes, dedicated routes, medical courier services, legal document delivery, and parcel delivery.
3. Customer Responsibilities
You agree to:
Provide accurate pickup and delivery addresses, contact information, and special instructions.
Ensure someone is available to release the shipment at pickup and receive it at delivery.
Properly package items to withstand the ordinary rigors of transport. BPC is not liable for damage due to inadequate or defective packaging.
Accurately declare the contents and value of the shipment. You are solely responsible for declaring any hazardous, prohibited, or illegal materials. Failure to do so will result in immediate termination of service and may lead to legal action.
4. Prohibited Items
The following items are strictly prohibited. BPC will not transport them under any circumstances:
Hazardous materials (e.g., explosives, gases, flammable liquids, toxic substances).
Illegal drugs, narcotics, or paraphernalia.
Firearms, weapons, or ammunition.
Currency, cash, or monetary equivalents (e.g., bonds, stock certificates).
Live animals.
Perishable food items without prior written agreement and proper arrangements.
Any item prohibited by local, state, or federal law.
5. Payment Terms
Quotes are based on information provided by the Customer. Final charges may vary based on actual weight, dimensions, wait times, or changes to the order.
Payment is due upon receipt of invoice unless prior credit arrangements have been made and approved in writing by BPC.
A late fee of 1.5% per month (18% APR) will be applied to all overdue balances.
The Customer is responsible for all applicable taxes.
6. Liability and Limitations of Liability
BPC’s liability for loss, damage, or delay is strictly limited.
For any shipment, our maximum liability shall not exceed $100.00 or the actual value of the item(s) as declared in writing by the Customer at the time of pickup, whichever is less.
BPC is not liable for any consequential, indirect, incidental, or special damages (including lost profits or income) resulting from loss, damage, or delay, regardless of the reason.
To be eligible for a claim, the Customer must notify BPC in writing of any loss or damage within 24 hours of delivery.
7. Claims Process
Any claim for loss or damage must be submitted in writing to [Your Email Address] within 24 hours of delivery. The claim must include the invoice number, a description of the damage or loss, and photographic evidence. Claims are subject to investigation and will be processed according to the liability limits outlined in Section 6.
8. Force Majeure
BPC shall not be held liable for any failure or delay in performance due to causes beyond its reasonable control, including but not limited to: acts of God, war, terrorism, severe weather, road closures, accidents, labor disputes, or government restrictions.
9. Indemnification
The Customer agrees to indemnify and hold harmless BPC, its owners, and employees from any claims, damages, losses, or liabilities (including legal fees) arising from the Customer’s breach of these Terms, misuse of the Services, or violation of any law.
10. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the State of Indiana. Any dispute arising from these Terms or the Services provided shall be resolved in the state courts located in Hamilton/Marion County, Indiana.
11. Changes to Terms
BPC reserves the right to modify these Terms and Conditions at any time. Changes will be posted on this page with an updated “Last Updated” date. Your continued use of our Services after any changes constitutes your acceptance of the new Terms.
